Welcome to Play Smash or Pass (“we”, “us”, “our”). The website playsmashorpass.com, including themed game pages, information pages, and related online services we operate (collectively, the “Service”), is offered subject to these Terms of Use (the “Terms”).

By accessing or using the Service, you confirm that you can form a binding agreement and that you accept these Terms and our Privacy Policy. If you do not agree, do not use the Service.

We may revise the Terms from time to time. The “Last updated” date reflects the current version. Continued use after changes become effective constitutes acceptance of the updated Terms.

Play Smash or Pass provides browser-based entertainment games in which you view fictional characters or similar items and choose Smash, Pass, or (where available) Skip. Features may include progress through a lineup, community percentages, result summaries, shareable result images, and guides on how to play.

Free games currently do not require an account. We may add optional features later—such as a custom game creator, saved lineups, or moderated submissions. Those features may include additional terms when you use them.

We do not guarantee that any particular game, character, statistic, or feature will remain available forever. Lineups can change as we correct mistakes, respond to rights requests, or improve the lists.

You must be old enough to use online services under the laws of your region. If you are under the age of majority, you should use the Service only with permission from a parent or guardian where required.

The Service is general-audience entertainment. Some pages discuss or depict mature fictional themes common to anime, games, and pop culture. You are responsible for deciding whether the content is appropriate for you or for anyone using your device.

Free play today does not require registration. If we introduce accounts, private edit links, or uploaded custom games, you agree to:

• Provide accurate information when prompted
• Keep passwords or private edit links confidential
• Remain responsible for activity under your access
• Notify us promptly at support@playsmashorpass.com if you suspect unauthorized use

We may refuse, suspend, or delete custom content or access that violates these Terms or creates risk for other players.

You agree not to misuse the Service. Prohibited conduct includes, without limitation:

• Using bots, scripts, scrapers, or bulk automated votes to manipulate community statistics
• Trying to disrupt, overload, probe, or copy non-public parts of the Service
• Bypassing security protections or access limits
• Uploading or linking malware, or using the Service to distribute spam
• Submitting unlawful, hateful, harassing, or sexually exploitative content—especially anything involving minors—if player uploads become available
• Impersonating Play Smash or Pass, our support address, or another person
• Using the Service to rate or harass real private individuals
• Infringing intellectual property or privacy rights of others
• Using the Service for any purpose that is illegal in your jurisdiction

We may slow, block, or investigate traffic that appears abusive. Report concerns to support@playsmashorpass.com.

Smash or Pass is subjective entertainment. Your picks reflect a momentary opinion about a fictional presentation, not advice, not a scientific ranking, and not a statement of fact about any real person.

Community percentages and counters are approximate combined totals. They can lag, reset during maintenance, miss some visits, or be skewed by unusual traffic despite our protections. Do not treat them as official franchise rankings or as a complete record of every visitor’s private opinion.

Result images or share text you create are your responsibility when you post them elsewhere. Be kind and follow the rules of whatever platform you use.

Our rights

The Service’s original layout, visual design, writing, software, logos we create (such as the on-site “S/P” mark), and the way our game experiences are put together are owned by us or licensed to us and are protected by intellectual property laws. You may not copy the site wholesale, mirror it, or reuse our software for a competing service without permission.

Franchise and third-party rights

Character names, portraits, trademarks, game titles, and related franchise materials are the property of their respective owners. References on this site are for entertainment identification only. Play Smash or Pass is a fan-made independent project and is not affiliated with, endorsed by, or sponsored by those rights holders unless we explicitly state otherwise.

Copyright and takedown notices

If you believe material on the Service infringes your copyright or other rights, email support@playsmashorpass.com with:

• Identification of the work or mark claimed to be infringed
• The page link(s) and a description of the material
• Your contact information
• A statement of good-faith belief and authority to act
• Your signature (physical or electronic)

We will review complete notices and take action we deem appropriate, which may include removal.

If you send us content—such as feedback, custom lineup materials in a future creator, or images attached to a support request—you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt as needed to display it properly (for example resizing an image), show, and distribute that content as needed to operate and improve the Service and to respond to you.

You represent that you have the rights needed to grant this license and that your content does not violate law or third-party rights. You remain the owner of your content subject to this license and to any franchise restrictions that apply to materials you upload.

The Service may link to third-party websites, social apps, or other online sources. We are not responsible for their content, policies, or practices. Your use of third-party services is governed by their terms.

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free; that community statistics will be accurate or complete; or that defects will be corrected. Entertainment outcomes are subjective. Nothing on the Service is professional, legal, medical, or financial advice.

Some places do not allow certain warranty disclaimers. In those places, portions of this section may not apply to you to the extent prohibited.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR OPERATORS, CONTRACTORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US TO USE THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) USD $50. BECAUSE THE CORE GAMES ARE FREE, SECTION (B) WILL OFTEN BE THE APPLICABLE CAP.

These limits apply even if a remedy fails of its essential purpose. Some regions do not allow certain limitations; in that case our liability is limited to the fullest extent permitted.

You agree to defend, indemnify, and hold harmless Play Smash or Pass and its operators from and against claims, damages, losses, and expenses (including reasonable legal fees) arising out of your misuse of the Service, your user content, or your violation of these Terms or applicable law.

We may suspend or terminate access to all or part of the Service at any time, with or without notice, if we believe it is necessary to protect the Service, comply with law, or address a Terms violation. You may stop using the Service at any time.

Provisions that by their nature should survive—including intellectual property, disclaimers, limitation of liability, indemnity, and governing law—will survive termination.

Unless mandatory local consumer law says otherwise, these Terms are governed by the laws of the jurisdiction in which the Service operator principally maintains the website, without regard to conflict-of-law rules. Courts in that jurisdiction will have exclusive venue for disputes that cannot be resolved informally, except where applicable law gives you a right to bring claims in your home country.

• Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service.
• Severability. If a provision is unenforceable, the remaining provisions stay in effect.
• No waiver. Failure to enforce a provision is not a waiver of the right to do so later.
• Assignment. You may not assign these Terms without our consent. We may assign them in connection with a reorganization or sale of the Service.
• Headings. Headings are for convenience only.
